5. Website Development Terms
When you engage Braysons Engineering & Tech for website development services, you agree to pay seventy-five percent (75%) of the total agreed project cost upfront before any design or development work begins. The remaining twenty-five percent (25%) balance shall be payable within seven (7) calendar days from the date we hand over the completed website, either by providing access credentials, delivering files, or hosting the live website. Upon settlement of the full balance, you will be granted a three-week (21-day) period to request reasonable changes, adjustments, or corrections to the delivered website. After the expiry of this window, any new modifications or requests will be treated as a new scope of work and will attract additional charges subject to a fresh agreement.
6. Suspension and Deletion for Non-Payment
If a client fails to clear the pending balance within three (3) weeks after handover, Braysons Engineering & Tech reserves the right to suspend the website. Suspension entails disabling access to the website and withholding any ongoing technical support. Should the pending balance remain unpaid for a period of two (2) months from the date of suspension, the website files, data, and backups will be permanently deleted from our servers. This practice is essential to maintain system efficiency, data security, and server resource management. Furthermore, it protects Braysons Engineering & Tech from indefinite storage and liability risks associated with maintaining unpaid projects. This policy aligns with the Computer Misuse and Cybercrimes Act, 2018, and the Kenya Information and Communications Act (Cap 411A), which empower service providers to manage digital assets responsibly. Should a client wish to have a new website after deletion, a fresh engagement will be required, including a new financial commitment, as recovery of erased data is not possible once removed from our system.
